Terms and Conditions of Business

1. Subject Matter:
This Waiver pertains to the business and transportation of all vehicles, carried out by Voit Transport.
2. Acknowledgment of Risks:
Customer acknowledges that the transportation of motor vehicles involves inherent risks, including but not limited to:
● Road Hazards: Potential damage from potholes, debris, road construction, and other unforeseen road conditions.
● Weather Conditions: Potential damage from rain, snow, hail, high winds, and other inclement weather.
● Loading and Unloading: Potential damage during loading, securing, and unloading of the vehicle onto and from the carrier.
● Third-Party Negligence: Potential damage caused by the negligence of third parties, such as other drivers, construction crews, or vandals.
● Pre-existing Conditions: Potential aggravation or discovery of pre-existing mechanical or cosmetic damage during transport.
3. Waiver of Liability:
Customer hereby expressly waives any and all claims against Vehicle Operations & International Transport trading as Voit Transport, for any and all losses, damages, or injuries to
the vehicle, including but not limited to:
● Mechanical Damage: Engine damage, transmission damage, suspension damage, and
other mechanical malfunctions.
● Cosmetic Damage: Scratches, dents, broken glass, and other cosmetic imperfections.
● Interior Damage: Damage to upholstery, carpets, electronics, and other interior components.
4. Exceptions: This Waiver does not apply to:
● Damage caused by Carrier's gross negligence or willful misconduct.
● Loss of the entire vehicle.
5. Inspection: Customer acknowledges that they have inspected the vehicle prior to loading and noted any pre-existing damage on the Bill of Lading or a separate inventory sheet. Customer further
acknowledges that they will inspect the vehicle upon delivery and promptly notify Carrier (Voit Transport) of any damage not previously noted.
6. Insurance Coverage: Customer acknowledges that Carrier maintains commercial public liability, auto transport liability and goods in transit insurance in accordance with applicable law. However, customers are responsible for obtaining and
maintaining comprehensive and collision insurance coverage for their vehicle during transport.
7. Governing Law: This Waiver shall be governed by and construed in accordance with the laws of the State of United Kingdom.
8. Entire Agreement: This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
9. Severability: If any provision of this Waiver is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
10. Binding Effect: This Waiver shall be binding upon and inure to the benefit of the parties hereto and their
respective successors and permitted assigns.
11. Execution: By making a booking and using Voit Transport, Customer acknowledges that they have read, understood, and agree to the
terms and conditions of business.
